Premises liability is one of the fastest growing segments of personal injury claims for both residential and business owners. According to the law, property owners are obligated to provide safe, secure and properly maintained premises. Regardless of how or why a person enters a property, property owners may be held liable if injury occurs. If you have fallen and been injured on somebody else's property, you may claim reasonable compensation for your pain and suffering, mental anguish, lost capacity for the enjoyment of life, as well as medical bills and lost wages.

Many factors can impact the outcome of a fall-down injuries/premises liability case. Did the injury result from a natural or artificial condition of the premises? Was the property satisfactorily maintained? Was the facility inadequately secured?

Generally, the law provides for compensation of preventable accidents, but a property owner is not automatically responsible for a fall-down injury simply because it happened on his property. The injured person must prove:

  1. The existence of a hazardous condition; and
  2. That the dangerous condition was either created by the property owner or his employees or was actually known by the property owner or his employees or that the property owner or his employees should have known of the existence of the hazardous condition.
In their defense, property owners, their insurance companies and attorneys will argue that there was no hazardous condition, or if there was, they didn't create it, didn't know about it and that the plaintiffs themselves are to blame because they were negligent.

If you have fallen and been injured on someone else's property, you should report your accident to the property owner as soon as possible. Gather names, addresses and the telephone numbers of any eyewitnesses. Immediately seek medical treatment for all injuries and follow all doctors' recommendations for treatment.

Keep copies of all of your medical bills (even those paid by insurance) and off-work slips. You may also want to keep a diary to record your thoughts about your medical treatment or the pain and suffering caused by your injuries. Photographs of the hazardous/dangerous condition which caused the fall can be very important. Stained, soiled, torn clothing worn at the time of the fall is important evidence, too; as is the footwear worn at the time of the fall. They should be set aside and not worn anymore. Try to obtain a copy of any incident report written by the business where you fell, although you probably will not get this. Doing these things will help our office prepare your case.
